By accessing or using the AI Chat Assistant service provided by Dune Digital ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users who interact with our AI-powered chat assistant through Facebook Messenger, Instagram Direct, or any other supported messaging platform.

2 Description of Service

Dune Digital provides an AI-powered messaging assistant designed for beauty clinics and aesthetic professionals. The Service enables:

• Automated appointment booking, rescheduling, and cancellation
• Information about clinic services and procedures
• Customer consultation and inquiry handling
• Appointment reminders and notifications

The Service operates through Meta platforms (Facebook Messenger and Instagram Direct) and is powered by third-party AI technologies.

3 User Responsibilities

By using the Service, you agree to:

• Provide accurate and truthful information when booking appointments or making inquiries
• Use the Service only for lawful purposes and in accordance with these Terms
• Not attempt to manipulate, deceive, or abuse the AI assistant
• Not use the Service to send spam, unsolicited messages, or harmful content
• Notify us promptly if you need to cancel or reschedule an appointment

4 Appointment Booking and Cancellation

When using our Service to book appointments:

• Appointment confirmations are subject to availability and clinic confirmation
• Cancellations must be made at least 24 hours in advance unless otherwise specified
• No-show or late cancellation policies are determined by the individual clinic
• The AI assistant facilitates bookings but final confirmation rests with the clinic

5 Data Collection and Privacy

Your use of the Service is subject to our Privacy Policy.

By using the Service, you consent to the collection and processing of:

• Your name, phone number, and contact information
• Appointment details and service preferences
• Message history with the AI assistant
• Platform identifiers (Facebook ID, Instagram ID)

We process this data solely to provide and improve the Service. We do not sell your personal data to third parties.

6 Limitation of Liability

To the fullest extent permitted by applicable law, Dune Digital shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of the Service
• Errors or inaccuracies in AI-generated responses
• Service interruptions, delays, or technical failures
• Actions taken by clinic staff based on AI assistant communications

The Service is provided on an "as is" and "as available" basis without warranties of any kind.

7 Intellectual Property

All content, technology, and materials associated with the Service are the property of Dune Digital or its licensors. You may not copy, reproduce, or distribute any part of the Service without our express written permission.

8 Third-Party Platforms

The Service operates through Meta platforms (Facebook, Instagram). Your use of these platforms is subject to Meta's own Terms of Service and Community Standards. Dune Digital is not responsible for changes to Meta platform policies that may affect the Service.

9 Modifications to Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting to dunedigital.agency/terms. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10 Termination

We reserve the right to suspend or terminate access to the Service at our discretion, including for violation of these Terms, abusive behavior toward the AI assistant, or any other conduct deemed harmful to users or the Service.

11 Governing Law

These Terms are governed by the laws of Ukraine. Any disputes arising from the use of the Service shall be subject to the jurisdiction of Ukrainian courts.
